Gemini Inks Apex Deal to Widen Its Regulated Prediction Markets Footprint

Gemini has struck a deal with Apex Fintech Solutions. The arrangement makes Gemini the exclusive CFTC-regulated venue for crypto event contracts offered through Apex’s futures commission merchant business, CoinDesk reported on Aug. 24.

The pairing connects Gemini Titan, the exchange’s CFTC-designated prediction market affiliate, with Apex’s broker-distribution infrastructure. Apex operates as a registered FCM and already markets a turnkey prediction markets solution to wealth platforms. For Gemini, that’s a pipeline into retail brokerage accounts its own exchange doesn’t reach directly.

The deal lands in the middle of a regulatory brawl. New York City widened a probe into prediction market platforms including Gemini, Kalshi, Polymarket, and Coinbase on Aug. 12, according to brokerchooser.com. The CFTC proposed a rule in June that would amend Rule 40.11 to codify its contract-specific review process for event contracts. Gemini itself moved to intervene in the CFTC’s suit against New York in June, court records show.

Gemini has been building toward this position since December. The CFTC approved Gemini Space Station’s application for a designated contract market on Dec. 10, 2025. That clearance allowed its Titan affiliate to list event contracts, binary yes-or-no instruments on future events, according to the company’s investor release. The platform went live within days, DeFiRate reported.

Titan runs as a centralized exchange. Fiat-collateralized contracts. Traditional clearing. Centralized custody. It’s a deliberate contrast to offshore venues like Polymarket that have drawn state-level enforcement attention.

Revenue from the segment has been modest so far. Finance Magnates reported in February that Gemini called prediction markets its biggest growth opportunity despite the segment bringing in $500,000. The Apex deal is the clearest signal yet of how Gemini plans to scale that revenue. The strategy: distribute through a partner’s broker network rather than relying on direct exchange traffic.

Apex’s existing prediction market infrastructure was built around Kalshi. Finance Magnates noted in February that Apex had “turned Kalshi into an add-on for broker platforms” through its FCM solution. Whether the Gemini arrangement replaces or supplements that Kalshi relationship was not specified in the CoinDesk report.

The competitive logic is straightforward. Kalshi holds the first-mover advantage as a CFTC-regulated event contract exchange. Polymarket, the largest prediction market by volume, operates offshore and has been pushing toward US compliance and banking ties. CME Group entered the space with its own $1 event contracts. Gemini’s bet is that distribution through an FCM like Apex, which already serves broker-dealer clients, can reach traders who would never visit a standalone prediction market.

Regulatory uncertainty cuts both ways. The CFTC’s proposed rule, published in the Federal Register on June 12, would formalize the agency’s contract-specific approach to determining whether event contracts serve the public interest. Congress is separately weighing whether the CFTC’s claim of exclusive jurisdiction over event contracts holds against state regulators who have moved to ban or restrict them.

Gemini’s motion to intervene in the CFTC’s case against New York signals its legal posture. The exchange wants a seat at the table in the fight over whether state regulators can override federal jurisdiction over event contracts. A favorable ruling would protect Gemini’s ability to offer prediction markets nationwide through partners like Apex.

Specific terms of the Gemini-Apex deal were not detailed in the CoinDesk report. That includes duration, financial structure, and which contract types fall under the exclusivity arrangement. Neither Gemini nor Apex has separately confirmed the deal through press releases.

Traders, as ever, disagree on whether prediction markets are the next options or a regulatory time bomb. The positioning is happening anyway.
